The KBC (Kiteboarding Club) – a travel agent

The KBC (Kiteboarding Club) acts exclusively as a travel agent and broker for water sports services. The contract is concluded directly between the customer and the respective provider (e.g., hotels and the respective water sports center).
 

Cancellations

The booking is binding. The booked service can be canceled directly with the location via email or phone. The following cancellation terms apply:

• Cancellation Policy for KBC El Gouna, KBC Ras Soma, KBC Sicily, KBC Dakhla, New Spirit Dakhla, KBC Sal, KBC Parajuru, and KBC Tarifa:

1. Up to 3 weeks before the scheduled arrival date: free of charge.
2. Between 21 and 8 days before the scheduled arrival date: 25% of the booked service
3. Between 7 days and 1 day before the scheduled arrival date: 50% of the booked service
4. In case of a no-show, 100% will be charged.

• Cancellation Policy for KBC Holland and KBC Brouwersdam:

1. Up to 7 days before the scheduled arrival date: no charge.
2. Between 6 days and 1 day before the scheduled arrival date: 50% of the booked services
3. In case of a no-show, 100% will be charged.
    

Hours of Operation

The KBC is open daily from 9:00 a.m. until sunset.
Use of the spot and all center services is permitted exclusively during official opening hours. Outside of operating hours, there is neither supervision nor rescue service available. Kitesurfing and wingfoiling outside of opening hours are prohibited.
 

Payment Terms

Payment must be made at the center on the first day. Any subsequent invoices must be paid by 5:00 PM on the day of departure at the latest.
The KBC accepts cash or credit card payments (euros, MAD, or U.S. dollars).
KBC vouchers may only be used for KBC services (rentals, courses, and storage/beach use).
No refunds will be issued for services that were booked but not used or only partially used by the customer. This applies in particular to courses and lessons that were not attended or were terminated early, individual unused parts of courses, as well as booked but unused equipment rental fees. Any unused balances or partial services from vouchers will not be paid out or refunded.
 

Disclaimer

KBC provides its services with the utmost care. Nevertheless, water sports are inherently associated with risks that cannot be completely ruled out, even with strict adherence to all safety standards. By signing, the participant confirms that they are aware of these risks and accept them.

KBC assumes no liability for personal injury or property damage resulting from slight negligence. Liability for willful misconduct, gross negligence, as well as for damage to life, limb, or health, and mandatory statutory claims remains unaffected by this provision.

The KBC is not liable for loss, damage, or theft of personal belongings, including those stored in lockers or in the guest storage area. Participants are advised to obtain adequate personal insurance (in particular, accident and personal liability insurance).

The following applies to minors: Participation is permitted only with the consent and signature of a legal guardian.
 

Health & Personal Responsibility

Participation in courses, rental of equipment, and use of the facility are at the participant’s own risk. Each participant or renter is obligated to strictly follow the safety instructions of the staff, use the equipment responsibly, and not endanger themselves or others.

The participant confirms that they are not aware of any health limitations that could make participation dangerous. Health risks, illnesses, or limitations must be reported to KBC staff immediately. Likewise, injuries or feelings of illness must be reported to the KBC team immediately.

Participation while under the influence of alcohol, drugs, or performance-altering medications is not permitted.
 

Courses and Course Conduct

Courses generally begin at 9:00 a.m. on the first booked day.
If the practical portion cannot take place due to winds that are too strong (>25 knots) or too weak (<12 knots), the course will be rescheduled or replaced with a voucher of equivalent value. The KBC Event Week is an exception to this rule—in the event that the practical portion is canceled, an alternative program will be offered.

There is no entitlement to a refund of the course fee if the participant withdraws from the course for personal reasons.
 

Sports Equipment and Rental

Rental equipment must be returned by 5:30 p.m. at the latest. If the renter is not sufficiently qualified to use the equipment safely, the KBC may refuse to rent it out. The KBC is entitled to terminate the contract and retain the rental fee.

The renter is liable for loss or damage to the equipment and bears the resulting costs. Any damage must be reported upon return.

The KBC team inspects and maintains the equipment regularly. Nevertheless, the participant is obligated to carefully inspect the equipment before each use, immediately report any defects or concerns, and use only suitable, functional equipment. Mandatory safety equipment (e.g., helmet, impact vest, leash) must be worn—if specified by the center.
 

Equipment Insurance

KBC equipment insurance (if available at the center) covers damage up to €300 per claim, with no deductible. The renter is responsible for any damage exceeding this amount. Loss of equipment is not covered.

Damage caused by winds exceeding 25 knots (on land or on the water), during extremely low water levels, as well as damage to directional boards (e.g., broken fins) and foil equipment is not covered. The insurance covers only damage to the rented equipment caused by the policyholder—it does not cover personal injury or damage to third parties.
 

Safety Rules

The use of kites and wings always involves a residual risk—even under professional supervision and with certified equipment. The instructions of KBC staff must be followed at all times.

– Independent takeoffs and landings are not permitted
.– When taking off or landing at the water’s edge, the kiter must be at least 20 meters (line length) into the water
.– Remaining on land with the kite in the air is strictly prohibited.
– The international right-of-way rules (posted at the center) must be observed
.– Minimum distance from other kiters: 50 meters, especially from beginners
.– Jumping while kiting within 50 meters of the beach is prohibited.
– The rescue boat operates exclusively in deep water behind the reef (if present) within a 500-meter radius of the station
.– Kitesurfing or wingfoiling outside the safety zone (500-meter radius around the station) is not permitted.
– In the event of dangerous weather or wind conditions, official warning signals, or instructions from the center team, you must immediately cease the activity and return to shore
.– Accidents or injuries must be reported immediately; an accident report must be completed.

The KBC reserves the right to exclude individuals from using its facilities (courses, rentals, beach access) if they pose a safety risk. In such cases, there is no entitlement to a refund.
 

Photos and Videos

I agree that photos and videos taken of me at the KBC Center may be used for commercial purposes (e.g., the KBC website, print advertisements, and social media channels).
 

Storage of My Data

I am aware that my data will be stored by the KBC Center and shared with the booking systems Kitehub and/or LEAO operated by Nerdsquad UG (limited liability) in order to properly plan and carry out all booked services.

The following data will be stored: first name, last name, length of stay, email address, booked services, billing address, date of birth, phone number, and accommodation.

The data will be stored and—unless statutory retention periods apply—automatically deleted after 10 years. You may request access to, a copy of, correction of, or deletion of your data at any time by emailing team@kbc-world.com. You also have the right to contact the competent data protection authority.
 

Severability Clause

The applicable national law at the Center’s location shall apply in addition. Should any provision be invalid, the validity of the remaining provisions shall remain unaffected. Invalid provisions shall be replaced by provisions that most closely reflect the economic purpose.
 

Contract Conclusion and Cancellation

By signing, the participant confirms that he or she has understood and will comply with all KBC safety rules. The instructions of the instructors and center staff must be followed. The KBC does not provide insurance for personal risks.

The booking is binding. The following cancellation policy applies:
– 21 to 8 days before arrival:
25%– 8 days to 1 day before arrival:
50%– On the day of arrival or in case of a no-show: 100%

By signing the registration form (including the Terms and Conditions on the reverse side) at the Center, I confirm that I have read and understood these Terms and Conditions and will abide by these rules.
